Our general terms and conditions are the foundation of our successful business dealings with our customers, which are carried out in a spirit of fair and constructive partnership. They offer security and predictability to both sides and are regularly adapted to fulfil the requirements of changing legislation.

General Terms and Conditions of Business

§ 1 Content of the Offer and Liability

We receive the information for our real estate offers from the owners or the respective sources provided in the offer. We forward this information to you without verification of the accuracy. All offers are subject to change, the right to an interim sale is reserved. Binding agreements on our part are required to be in writing to be effective.

§ 2 Subject of the Assignment and Amount of Commission

The subject of the order is the confirmation and/or the brokering of the respective contractual matter. Insofar as no alternative conditions are stated in the offer (exposé) or are agreed between the parties, in the event of a successful case the buyer/seller shall issue the commission as follows:

Letting and Leasing:

Residential: 2.38 months base rent incl. VAT.

Commercial: 3.57 months base rent incl. VAT.

Sale:

For a contract value

of up to 50,000 €: 3,000 € excl. VAT. = 3,570 €,

from 50,000 €: 6% excl. VAT. = 7.14 %,

to be paid by the seller.

Commission is payable upon the conclusion contract (lease, loan, purchase agreement…). In the event of a fee in accordance with an hourly rate, the net fee is 75.00 € excl. applicable VAT, currently 89.25 €.

§ 3 Distribution Prohibition

Our offers are only intended for the recipient. Forwarding is not permitted. In the event of forwarding and a conclusion of contract on the part of a third party, you shall also be subject to pay commission.

§ 4 Permitted Dual Agency

We are also permitted to agent for the other principal client subject to commission.

§ 5 Information Regarding the Principal Agreement

We are entitled to be present during the conclusion of the contract and the provision of a full copy of the contract, also in the event of absence upon the conclusion of contract. In the event that a contract is concluded without our cooperation, the contracting party is to be named and verified.

§ 6 Severance Clause and Legal Venue

In the event that one of the aforementioned clauses should be invalid in full or in part, this shall not prejudice the remaining provisions.

Legal venue for commercial customers and persons not residing in Germany is Berlin.
